These three patent enforcement
actions and settlements typify those that have been
effectively brought by the individual inventor and small
business against industry leaders. The recent success
of small inventors, the licensing companies and the
law firms that represent them, in many cases on a contingency
fee basis, has leveled the playing field allowing the
small inventors the same patent licensing benefits that
large corporations have always enjoyed.
"The recent developments in patent enforcement
and licensing have allowed the individual inventor and
small business the opportunity to benefit from their
inventions. It is our belief that we are in a position
to further enhance shareholder value by taking every
action possible to propel the benefits provided by our
patent portfolio. We benefit by carving out a position
in the OPT-IN e-mail industry and create business relationships
in support of our growth that are protected by a portfolio
of patents," said Thomas L. DiStefano III, CEO
of Sticky Web, Inc.
The OPT-IN e-mail industry
is made up of hundreds of companies that encompass small
entrepreneurs to large public Companies. These companies
provide e-mail management and marketing services that
range from the fully automated ASP, in-house campaign
management, and do-it-yourself software packages. In
most cases OPT-IN e-mail management and marketing services
include; targeting a specific segment, sending e-mail
to that segment, creating a report on the status of
the sent e-mail, and creating an action to reach specific
goals set by the marketer.
"A patent allows
its owner to prohibit others from making, using or marketing
the patented invention. A patent is an opportunity to
create a product or service that only the inventor may
produce," stated Thomas L. DiStefano III, CEO of
Sticky Web, Inc. "Many companies and inventors
have not been able to get their inventions to market
and have relied on licensing to derive value. We are
going into this market from both sides, as an operator
with the best solution and then as licensor protecting
the solution," continued Mr. DiStefano.
The estimated market spending
on permission-based, or OPT-IN, e-mail marketing has
grown to over $7.3 billion in 2005 according to independent
studies. The studies do not include revenues generated
from illegal SPAM.
